These Terms of Service ("Terms") are an agreement between you and Klinetek Solutions ("Klinetek," "we," "us") governing your use of the Wherewithal mobile application (the "App"). By installing or using the App you agree to these Terms. If you do not agree, do not use the App.
Wherewithal is a personal-finance application that runs on your device. It lets you import your own bank-statement files, categorize spending, track debts and goals, and plan budgets. Optional AI-assisted features (such as automatic merchant naming and statement reading) are provided via a subscription after a free trial, as described in Section 4.
Wherewithal is an organizational tool, not a financial adviser. Numbers the App shows you — including spending summaries, categorizations, payoff dates, interest estimates, payday predictions, and any AI-generated content — are estimates produced from the data you provide, and they can be wrong, incomplete, or out of date. They are provided for general informational purposes only and are not financial, legal, tax, or investment advice, and no fiduciary or advisory relationship is created by your use of the App. Always verify balances, rates, due dates, and payoff amounts with your bank or lender before making financial decisions. You are solely responsible for your financial decisions.
The App stores your data on your device (see the Privacy Policy). Because we keep no copy, you are responsible for safeguarding your device and for making backups using the App's export feature. If your data is lost — through deletion, device loss, or otherwise — we cannot recover it. Everything you import remains yours; these Terms give us no rights over your financial records beyond the limited processing described in the Privacy Policy.
AI features depend on third-party AI services and our relay infrastructure. You acknowledge that: (a) AI output can be inaccurate — review it before relying on it; (b) AI features require an internet connection and consent (you can disable them at any time, and the rest of the App keeps working); (c) we may set fair-use limits, and may change AI providers, models, or the scope of AI features to keep the service sustainable; (d) if a change materially reduces what a paid subscription includes, your remedy is to cancel renewal through your store.
The App is licensed for your personal, non-commercial use. You agree not to: use the App for unlawful purposes; attempt to extract, misuse, or overload our relay service or its credentials; circumvent usage metering, entitlements, or purchase verification; or interfere with other users' use of the service. We may suspend or limit access to the AI features (not your on-device data) where we reasonably believe these Terms are being violated.
We grant you a personal, revocable, non-exclusive, non-transferable license to use the App on devices you own or control, subject to these Terms and the rules of the store you got it from. The App, including its design, code, and branding, belongs to Klinetek Solutions or its licensors. You may not copy, modify, distribute, sell, or lease any part of the App, or reverse engineer it except where the law permits despite this restriction. Your data remains yours.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, ACCURACY, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT ESTIMATES AND AI-GENERATED CONTENT WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLINETEK SOLUTIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST SAVINGS, LOST DATA, OR FINANCIAL LOSSES ARISING FROM DECISIONS MADE IN RELIANCE ON THE APP — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US THROUGH THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) TEN U.S. DOLLARS (US$10). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING (WHERE APPLICABLE) STATUTORY CONSUMER RIGHTS.
You will indemnify Klinetek Solutions against claims arising from your violation of these Terms or misuse of the App, to the extent permitted by your local law.
You may stop using the App at any time; deleting it removes your on-device data. We may terminate or suspend the AI features or these Terms if you materially breach them. Sections 2, 3, and 7–13 survive termination.
Your store's own terms also apply. For Apple users: these Terms are between you and Klinetek only; Apple has no obligation to furnish maintenance or support and is not responsible for claims relating to the App; Apple is a third-party beneficiary of these Terms with the right to enforce them.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Pennsylvania — except that if you are a consumer in a jurisdiction whose law requires otherwise, mandatory local consumer protections and venue rules still apply. If any provision of these Terms is held unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement about the App. We may update these Terms; if we make material changes, we will update the effective date and note the change in the App's release notes, and continued use after the change takes effect constitutes acceptance.
